1. Introduction

These Terms of Use ("Terms") govern your access to and use of the SouthScape platform ("Platform"), operated by Harshitha S, having its registered office at 132, 6th cross, 1st A block, JP Nagar 8th ph, Bangalore, KA, India - 560076 ("SouthScape", "we", "us", "our").

By accessing the Platform, creating an account, or making a booking, you agree to be bound by these Terms.

2. Nature of Services

SouthScape is a digital booking platform facilitating:

  • Tour packages
  • Boat cruises
  • Stays and experiences
  • Ticket generation and booking confirmations

SouthScape facilitates bookings and ticketing. For bookings made directly on southscape.com, SouthScape is responsible for fulfillment. For partner-created packages and stays, including services offered on powered partner pages and partner custom domains, the partner is the service provider and is responsible for fulfillment, service delivery, and its refund/cancellation terms. SouthScape is not liable for partner-fulfilled services.

For partner online bookings, payments may be processed by the partner's payment gateway. In such cases, the partner is the merchant of record and is responsible for payment disputes, chargebacks, and refunds.

3. Booking and Confirmation

  • Bookings are confirmed only upon successful receipt of payment (advance or full, as applicable) or recorded offline payment through an authorized agent.
  • Advance payments may be allowed for selected services. The remaining balance must be paid on or before the travel date, failing which services may be denied.
  • Pricing displayed includes applicable taxes unless otherwise specified. Platform charges and convenience fees may apply.
  • Customers must carry valid government-issued ID (Aadhaar, Passport, Driving License) at the time of availing services. Failure to present valid ID may result in denial of service without refund.
  • You must provide accurate traveler details and contact information. Incorrect or incomplete information may result in denial of service without refund.

4. Refunds and Cancellations

Refunds are governed by our Refund and Cancellation Policy. For partner-created services, the partner policy may apply.

5. Force Majeure

SouthScape shall not be liable for failure or delay in performance due to events beyond reasonable control, including natural disasters, government restrictions, river navigation restrictions, weather disruptions, or transport shutdowns. In such cases, a full refund may be initiated as per the Refund and Cancellation Policy.

6. User Conduct

  • Provide accurate information during booking
  • Do not attempt unauthorized system access
  • Do not interfere with platform functionality
  • Do not engage in fraudulent booking activity
  • Do not initiate fraudulent chargebacks or payment disputes

Violation may result in account suspension or cancellation of bookings.

7. GST and Taxation

All applicable GST or statutory taxes will be charged as per Indian law. Customers are responsible for providing correct billing details.

8. Limitation of Liability

SouthScape's total liability shall not exceed the amount paid for the booking. SouthScape shall not be liable for indirect, incidental, special, or consequential damages, platform downtime, third-party services, or partner service failures.

9. Indemnity

You agree to indemnify and hold SouthScape harmless from any claims, losses, damages, liabilities, and expenses arising from misuse of the Platform, violation of these Terms, inaccurate information, or fraudulent disputes/chargebacks.

10. Dispute Resolution

Any dispute shall first be attempted to be resolved amicably. Failing which, disputes shall be subject to arbitration under the Arbitration and Conciliation Act, 1996. Governing law: India. Arbitration seat: Bangalore, KA, India. Courts of Bangalore, KA, India shall have exclusive jurisdiction.

11. Modifications

SouthScape may update these Terms. Continued use constitutes acceptance.
